Thus they have established laws and regulations around safety in the workplace that covers most industry. It does also offer some protections, but not complete protections.
Larry may request an inspection by OSHA to ensure that he has a safe working place, and if Larry is moved to the night shift as a result Larry would be able to file a complaint with OSHA. However it will be very difficult for Larry to prove that he was moved to the night shift as a result of his inspection request. And thus OSHA may not be able to offer him much protection from that. Larry would need to look towards other statutes to find remedies that can protect him or prove that this was a retaliatory act for his request.

If the cardboard baler without a safety shield potentially or easily puts Larry in a hazardous condition in which he or anyone else is very likely to injure or lose arms, it is an easily recognized hazard which Larry should report to his employer immediately.
