Probably the worst way to resolve a conflict between a patient and a healthcare provider is to go to court. The court is extremely time-consuming and expensive, and it typically results in the destruction of any relationship between the involved parties. Alternative dispute resolution (ADR) can be a better option in many cases. Describe a scenario where ADR might work to resolve a healthcare conflict, and discuss which type of ADR you would recommend. In your responses to classmates, describe how an ADR method they did not choose would also work in the scenario they recommended.
Classmate response chosen: “Alternative dispute resolution means settlement of civil disputes between parties using neutral mediators or arbitrators without going to court. For example: The patient went to see the doctor for help with a health issue. The doctor told the patient that he/she had a infection in their leg and it had to be amputated. The physician does the procedure and realizes the patient did not have a infection in their leg and did not need the amputation. The patient decides that he/she wants to sue the doctor for $1,000,000 but the doctor will not agree to it. The patient’s lawyer and the physician’s lawyer keep going back and forth on seeing what they can do to get their clients what they each wanted. The physician did not want to pay any money and the patient wanted compensation for wrongful diagnosis. Neither the physician and the patient wants to go to court to fight it. The physician’s lawyer asks to lower the amount for compensation. The patient thought about it and decided to lower the amount down to $80,000. The physician agrees to it. The method in this example would be they agreed to a lesser amoubcint so no one had to go to court.”
